On November 29, 2019, the Animal Rights Foundation (ARF), based on Law no. 06 / L-081 on Access to Public Documents, has submitted a formal request for access to the contract for services: “Treatment of stray dogs”, with identification number 651-19-6045-2-3-6 with internal number GI 651 19 079 236.
On December 16, 2019, ARF received a response from the Municipality of Gjilan with which it was provided with data such as: list of treated dogs, three samples from 133 treated dogs, photos of treated dogs treated with numbered eartags.
On December 17, 2019, ARF requested from the Municipality of Gjilan the completion of documents, respectively data regarding the exact place where each dog was released, photos in electronic format (colored), data on the use of euthanasia, data on the price for each treatment for 133 dogs. These data are foreseen by Article 17 of Administrative Instruction no. 04/2017 on technical conditions which must be met by the temporary treatment center for stray animals.
This request has not been addressed by the Municipality of Gjilan.
For this reason, on January 9, 2020, the Animal Rights Foundation filed a complaint with the Ombudsperson Institution (OI).
The Ombudsperson, in the letter of recommendation addressed to the Municipality of Gjilan, notes that this municipality, by not following the request of the Foundation, has acted in violation of the Constitution of Kosovo (Article 41, Paragraph 1), the Law on Public Procurement (04 / L-042 ) and the Law on Access to Public Documents (06 / L-081).
The Ombudsperson recommends that the Municipality of Gjilan address the complaint of the Animal Rights Foundation, in accordance with the Law on Access to Public Documents and the relevant legislation in force.
